Welcome to SafeChirp ("SafeChirp," "we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of safechirp.com (the "Site") and your purchase of any product offered through the Site, including the SafeChirp Personal Safety Alarm (the "Product"). By accessing the Site, placing an order, or using the Product, you agree to these Terms. If you do not agree, please do not use the Site or the Product.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you represent that you meet this requirement and that all information you provide is accurate.
2. Orders, Pricing, and Payment
All prices are shown in U.S. dollars and exclude any applicable taxes unless stated otherwise. We reserve the right to refuse, cancel, or limit any order, including orders that appear fraudulent, are placed by resellers, or contain pricing or product errors. Your order is not accepted until we send a shipment confirmation email.
3. Shipping and Delivery
Orders typically ship within 2 to 5 business days. Standard delivery generally takes 10 to 18 business days from the date of shipment, depending on your location and carrier conditions. Tracking information is provided by email once your order ships. Delivery dates are estimates and not guaranteed. Risk of loss passes to you on delivery.
4. Returns and Refunds
Our Refund Policy is part of these Terms and is available on the Site. Please review it for full details on the 30-day return window, how to request a refund, and the limited circumstances in which a return ship-back may be requested.
5. Safety Product Disclaimer; No Warranty of Personal Safety
SafeChirp is a personal safety alarm intended to draw attention in an emergency. It is not a weapon, not a self-defense device, and not a substitute for calling 911 or local emergency services. SafeChirp does not guarantee that the Product will prevent, deter, or stop any crime, assault, injury, or other harm. You are responsible for your own safety and for using common-sense precautions. In any emergency, contact local emergency services immediately.
6. Hearing and Use Warnings
The Product produces a sound rated at approximately 130 decibels when activated at close range. Sound at this level can cause hearing damage, startle reactions, panic, or other injury if discharged near the ear, near children or animals, or in confined spaces. You agree to: (a) keep the Product away from ears, faces, and confined spaces when activating; (b) test the Product only briefly and at arm's length; (c) supervise any use by minors; and (d) never use the Product as a prank, toy, or to harass others. You assume all risk of hearing loss, tinnitus, startle injury, falls, or other harm resulting from misuse.
7. Battery, Storage, and Maintenance
The Product contains a small battery. Do not disassemble, puncture, incinerate, expose to extreme heat, or submerge the Product. Replace batteries only as described in any included instructions. Store out of reach of children. Discontinue use and dispose of the Product if it is damaged, leaking, or swollen.
8. Limitation of Liability
To the maximum extent permitted by law, SafeChirp, its owners, officers, employees, suppliers, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, hearing, personal injury, emotional distress, property damage, or other intangible losses, arising out of or relating to the Site, the Product, or these Terms, whether based on warranty, contract, tort, statute, or any other legal theory, and whether or not SafeChirp was advised of the possibility of such damages. Our total cumulative liability to you for any and all claims is limited to the amount you paid for the Product giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless SafeChirp and its owners, officers, employees, suppliers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to (a) your use or misuse of the Product, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
10. Intellectual Property
The Site, the SafeChirp name, logo, product imagery, and all related content are owned by SafeChirp or its licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or use any of this content for commercial purposes without our prior written consent.
11. User Conduct
You agree not to use the Site or Product to engage in unlawful, harassing, threatening, or harmful conduct, to violate the rights of others, or to interfere with the operation of the Site. We may terminate or suspend access for any violation.
12. Changes to the Site, Product, and Terms
We may update the Site, the Product, pricing, promotions, or these Terms at any time. Updated Terms take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Product will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be held in New York, NY, or by remote/written submission, at the consumer's option. You and SafeChirp each waive any right to a jury trial and to participate in a class action. You may opt out of arbitration by emailing hello@safechirp.com within 30 days of your first purchase with the subject line "Arbitration Opt-Out."
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified only to the minimum extent necessary.
15. Entire Agreement
These Terms, together with our Refund Policy and Privacy Policy, are the entire agreement between you and SafeChirp regarding the Site and Product and supersede any prior agreements.
